What Is IRS Form 8821?

There are a number of life events or circumstances which cause a taxpayer to choose a surrogate to discuss and receive their tax information from the U.S. Internal Revenue Service (IRS). In other cases, a taxpayer may prefer to authorize someone more knowledgeable on tax issues to discuss their tax account with the IRS. In many such cases, the IRS Form 8821 is the form used to implement such authorizations. Understanding the form and its purpose is key to taking advantage of the authorizations it provides.

Purpose

    Form 8821 authorizes an individual other than the taxpayer to receive and discuss the taxpayer's tax account information. The form allows the IRS to disclose information to any third party including, but not limited to, a friend, accountant or tax preparer, etc.

How It Works

    On Form 8821, designate the tax period for which you are appointing a third party designee, as well as the name of your designee. After you complete IRS Form 8821 and mail it to the address listed in the instructions, the IRS will add the name of the third party designee to your account and that person will be authorized to discuss your tax account information.

Limitations

    Although Form 8821 authorizes the IRS to disclose information to a third party, it does not allow the person to represent you before the IRS. If you need to choose a representative, then complete IRS Form 2848 to name someone as your power of attorney.

Considerations

    You can revoke a previously filed Form 8821 by writing revoke across the top of the previously filed form and signing your name underneath your previous signature. Mail the form to the same IRS office to which you originally filed Form 8821. You can also revoke your previously filed Form 8821 by writing a letter to the IRS expressing your desire to revoke your Form 8821. Be sure to explicitly state in your letter that the authority granted via Form 8821 is revoked, the periods for which it is revoked, and the tax matters for which it is revoked.

Warning

    If Form 8821 is not received within 60 days of the date on which it was signed and dated by the taxpayer, it will be considered invalid. Also, the revocation of Form 8821 does not revoke IRS Form 2848. The process for revoking the authorizations associated with these two forms are totally separate.
