How to Fix Back Taxes Without Hiring a Lawyer

Regardless of whether the reason for accumulating back taxes is a consequence of your failure to file prior year tax returns or simply the result of lacking sufficient funds to make the payments, you can rectify the situation without having to incur the additional expense of hiring a lawyer. The Internal Revenue encourages you to get back on track with your taxes and doesn't require any legal expertise to do so.

    File your prior year tax returns. Just because you don't file a tax return doesn't mean that you aren't currently accruing penalties and interest on the taxes you already owe. The IRS is unable to assist you until it receives all missing tax returns that report your tax liability for each year. Once you file complete and accurate returns, the IRS can calculate the exact amount of tax, penalties and interest you owe. You can access the forms and instructions for the prior tax years you still need to file returns for on the IRS website (see Resources).

    Request a bill from the IRS that reports your current back-tax balance. You can't work on a resolution until you know the exact amount of your debt to the IRS. After you file all past-due returns, contact the IRS to request a Notice of Tax Due. This notice will advise you of your outstanding back-tax debt, including interest and penalties.

    Estimate a monthly tax payment you can afford. The IRS allows you to request an installment agreement so you can pay your back taxes on a monthly basis rather than in one lump-sum payment.

    Prepare Form 9465 with your estimate of the monthly payment you can afford to make, and mail it to the IRS. The agency will advise you whether it is accepting your request within 30 days.
