List of Things That Are Tax Deductible in a Superior Criminal Court Proceeding
Only fees incurred while trying to produce or collect taxable income, disputing tax or due to business are eligible for deduction on taxes. As a result, no list of fees stemming from a criminal case that a person can deduct on taxes exist; instead, a list of conditions and tests to determine if the Internal Revenue Service will approve deductions for legal fees is available.
Tax Claims
Tax cases that the Internal Revenue Service, or IRS, decides to prosecute as criminal cases may end up in a superior court. Tax law allows tax payers to deduct legal fees, such as lawyers' fees and court fees, in determining, collecting or getting a refund of any tax. A tax payer can argue that a criminal prosecution counts as determining a tax and deduct fees.
Produce or Collect Taxable Income
Superior courts have jurisdiction over criminal cases and civil cases involving large amounts of money in the court's geographical area. People involved in criminal cases where they are attempting to produce or collect taxable income -- like cases against employers regarding pay -- can deduct fees from the case.
Business Cases
Businesses can deduct fees from criminal cases that arose from business practices. If a business or its owner is sued for criminal negligence involving the business, the business can deduct the costs on its tax return. However, an owner or executive in a criminal case unrelated to normal business practices cannot deduct legal costs from his taxes.
Difficulty
Tax attorney Jeremy Temkin states that in contrast to civil cases, only a few criminal cases exist when either side can deduct costs on tax returns. Of the cases where a person can claim tax deductions, the ability to deduct hinges almost entirely on whether or not the case involves conduct in the person's business or trade.
